These Terms and Conditions ("Terms") govern your access to and use of EasyPZ, including our mobile application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree to these Terms, you may not access or use the Service.

Please read these Terms carefully. They contain important information regarding your rights, obligations, and limitations when using the Service.

1. Scope of Services

EasyPZ is a platform designed to provide information about restrooms and related facilities. The Service is offered "as is" and intended for informational purposes only. EasyPZ does not guarantee the accuracy, availability, or quality of any restroom listed in the Service.

Navigation and location services provided through the Service are intended for pedestrian use only. The Service may not account for accessibility needs, such as wheelchair access or terrain suitability, and should not be relied upon for vehicle navigation. EasyPZ is not responsible for any errors, unsafe routes, or reliance on these features. Users are expected to exercise caution and verify information independently.

The Service may include listings for restrooms located within public and private businesses. EasyPZ is not affiliated with, endorsed by, or in partnership with these entities unless explicitly stated. Listings are user-contributed and may not reflect real-time conditions.

2. User Responsibilities

By using the Service, you agree to comply with the following responsibilities:

  • Provide accurate, respectful, and truthful content when submitting reviews, comments, or other materials.
  • Maintain the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
  • Refrain from submitting content that:
    • Contains false, misleading, or defamatory information.
    • Includes abusive, harmful, or otherwise inappropriate material.
    • Violates any intellectual property or privacy rights.
  • Abstain from engaging in spam, unauthorized advertising, or other disruptive behavior.
  • Comply with all applicable local, national, and international laws and regulations.

Users are solely responsible for their actions and interactions within the Service. EasyPZ reserves the right to suspend or terminate accounts and remove content that violates these Terms.

3. User-Generated Content

The Service allows users to submit content such as reviews, comments, and ratings. By submitting content, you grant EasyPZ a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, and display your content within the Service.

You agree that submitted content will not:

  • Include offensive, defamatory, or discriminatory language.
  • Contain false or intentionally misleading information.
  • Promote illegal activities or violate applicable laws.

EasyPZ is not responsible for the content submitted by users but reserves the right to review, remove, or edit content that violates these Terms or is otherwise objectionable.

4. Business Listings and Liability

EasyPZ provides listings for restrooms that may be located within businesses or public spaces. These listings are based on user submissions and publicly available information. EasyPZ does not verify or guarantee the accuracy, availability, or condition of the listed restrooms.

Businesses that wish to have their listings removed from the Service may contact EasyPZ via the provided support channels. Upon receiving such a request, EasyPZ will review and address the matter promptly.

EasyPZ is not liable for any disputes, damages, or losses arising from user interactions with listed businesses or their facilities.

5. Data Use and Privacy

EasyPZ collects and processes data to improve the functionality and user experience of the Service. This may include anonymized location data, search history, and user-submitted reviews. Registered users may have certain data linked to their accounts to enable personalized features.

Data collected by EasyPZ may be shared in aggregated form with third parties, such as local governments or private organizations, to enhance restroom accessibility and related services.

EasyPZ is committed to protecting user privacy and complies with applicable regulations, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). For detailed information, refer to our Privacy Policy.

6. Gamification and Rewards

EasyPZ includes gamification features such as experience points (EXP) and in-app rewards to incentivize user participation. These rewards have no monetary value and cannot be redeemed for cash or other financial benefits.

Users found to engage in manipulative behaviors, such as submitting fake reviews or exploiting the reward system, may have their accounts suspended or permanently banned.

EasyPZ reserves the right to modify, revoke, or discontinue gamification features at its sole discretion.

7. Third-Party Services

EasyPZ integrates third-party tools and services, including navigation providers and analytics platforms, to enhance the functionality of the Service. By using the Service, you agree to comply with the terms and conditions of these third-party providers.

EasyPZ disclaims liability for any errors, interruptions, or damages caused by the use of third-party services. Users are encouraged to review the terms and privacy policies of any third-party service they engage with through EasyPZ.

8. Intellectual Property

All intellectual property rights related to the Service, including but not limited to trademarks, logos, designs, software, and databases, are owned by EasyPZ. Unauthorized use, reproduction, or reverse engineering of any part of the Service is strictly prohibited.

Users may not use EasyPZ’s intellectual property for any commercial purpose without prior written consent.

9. Indemnification

You agree to indemnify, defend, and hold harmless EasyPZ, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or related to:

  • Your use or misuse of the Service.
  • Your violation of these Terms or applicable laws.
  • Your infringement of any third-party rights, including intellectual property or privacy rights.
  • Any content or data submitted by you to the Service.

This indemnification obligation will survive the termination of your account or cessation of use of the Service.

10. Liability and Disclaimers

EasyPZ provides the Service "as is" without any warranties or guarantees, express or implied. To the fullest extent permitted by law, EasyPZ disclaims all liability for damages arising from:

  • Inaccuracies, errors, or omissions in restroom listings or user-submitted content.
  • Navigation errors or unsafe routes encountered while using the Service.
  • Disputes or interactions between users and businesses listed on the platform.
  • Technical issues, outages, or interruptions affecting the Service.

Users assume all risks associated with using the Service. EasyPZ is not liable for indirect, incidental, or consequential damages resulting from the use of the Service. In jurisdictions that do not allow exclusions of liability, EasyPZ’s liability will be limited to the extent permitted by law.

11. Dispute Resolution

Any disputes arising out of or related to these Terms or the use of the Service will be resolved through binding arbitration under the rules of the American Arbitration Association. Arbitration will take place in Delaware, USA, and each party will bear its own costs.

Exceptions to arbitration include claims brought in small claims court or disputes involving injunctive relief for intellectual property violations. By using the Service, you waive the right to participate in class-action lawsuits or collective legal actions against EasyPZ.

12. Age Restrictions

Users must be at least 13 years old to use the Service. By accessing the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian to use the Service.

13. Termination

EasyPZ reserves the right to suspend or terminate your access to the Service, with or without notice, for any reason, including but not limited to:

  • Your breach of these Terms or any applicable laws.
  • Engagement in fraudulent, abusive, or harmful behavior.
  • Submission of false or misleading information to the Service.
  • Actions that disrupt or interfere with the Service or its users.

Upon termination, your rights to use the Service will immediately cease. Any data or content associated with your account may be deleted or made inaccessible at EasyPZ’s sole discretion.

Termination of your access to the Service does not waive any rights or obligations accrued prior to termination.

14. Updates to Terms

EasyPZ reserves the right to modify or update these Terms at any time. Changes will be communicated to users through the Service or via email, if applicable. Continued use of the Service after updates are posted constitutes acceptance of the revised Terms.

15. Fraud and Security

Users are prohibited from engaging in fraudulent activities, such as creating multiple accounts to exploit rewards systems, submitting false information, or attempting to bypass security measures. EasyPZ reserves the right to investigate and take action against fraudulent behavior, including account suspension or termination.

While EasyPZ implements reasonable security measures to protect user data and ensure the integrity of the Service, it does not guarantee that the Service is free of vulnerabilities. Users are responsible for protecting their accounts and devices against unauthorized access, malware, and other security threats.

EasyPZ is not liable for damages caused by unauthorized access, data breaches, or other security incidents beyond its reasonable control.

16. Accessibility and Inclusivity

EasyPZ strives to provide an inclusive platform. Accessibility features and information, such as wheelchair-friendly restrooms, are user-contributed and may not always be accurate. Users are encouraged to verify accessibility details independently.

17. Refund Policy

EasyPZ currently does not offer refunds for any in-app purchases, subscriptions, or other services. Refund policies for future premium features will be outlined at the time of their introduction. Users are advised to review these policies carefully before making any purchases.

18. Compliance with Regulations

EasyPZ complies with applicable laws and regulations, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other data protection laws. These laws grant users rights such as:

  • The right to access and request a copy of your personal data.
  • The right to correct or delete your personal data.
  • The right to restrict or object to certain data processing activities.
  • The right to data portability, where applicable.

19. Force Majeure

EasyPZ is not liable for delays or failures in performance caused by events beyond its reasonable control. These events include, but are not limited to:

  • Natural disasters such as earthquakes, floods, or hurricanes.
  • Government actions, regulations, or restrictions.
  • Technical failures, including internet outages and server disruptions.
  • Cybersecurity incidents, such as data breaches or denial-of-service attacks.
  • Labor disputes, strikes, or shortages.
  • Pandemics, epidemics, or other public health emergencies.

During such events, EasyPZ will make reasonable efforts to restore the Service but cannot guarantee uninterrupted access or functionality. EasyPZ liable for losses incurred during force majeure events.

20. Feedback and Suggestions

Any feedback, suggestions, or ideas submitted to EasyPZ regarding the Service will become the exclusive property of EasyPZ. By submitting feedback, you agree that EasyPZ may use, modify, and implement your suggestions without any obligation to compensate you.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable, or if not possible, will be severed from these Terms without affecting the enforceability of the remaining provisions.

22. No Waiver

The failure of EasyPZ to enforce any right or provision under these Terms will not constitute a waiver of such right or provision. Any waiver must be provided in writing and signed by an authorized representative of EasyPZ to be effective.

23. Miscellaneous

These Terms constitute the entire agreement between you and EasyPZ regarding your use of the Service. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

EasyPZ’s failure to enforce any right or provision under these Terms does not constitute a waiver of such right or provision.
